These Terms & Conditions ("Terms") constitute a legally binding agreement between you (either an individual or entity) and Dream Hammer Media LLC ("Company," "we," "our," or "us") governing your access to and use of our website at dreamhammermedia.com (the "Site") and our services, including recruiting videos, athlete profiles, photography, game day coverage, and DIY profile packages (collectively, the "Services").
By accessing our Site or purchasing our Services, you agree to be bound by these Terms. If you do not agree, you may not access the Site or use our Services.

### 2. ELIGIBILITY AND CONSENT FOR MINORS
Our Services are intended for athletes of all ages. By using our Services:
- **If you are under 18:** You represent that you have obtained parental or guardian consent to use our Services and provide us with your information
- **If you are a parent or guardian:** You consent to your child's use of our Services and agree to be bound by these Terms on their behalf
- **You may not use our Services if you are under 13** without verifiable parental consent

### 3. DESCRIPTION OF SERVICES
Dream Hammer Media provides the following Services:

### 4. PAYMENT TERMS
**Pricing:** All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to modify pricing at any time, but such changes will not affect existing bookings.
**Payment Options:**

**Payment Processing:** All payments are processed securely through Stripe. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the applicable fees.
**Deposits:** For certain Services, a non-refundable deposit may be required to secure booking dates. The deposit amount will be communicated at the time of booking.
**Failed Payments:** If a payment fails, we will notify you and provide an opportunity to update your payment information. Failure to complete payment may result in suspension or cancellation of Services.
**Taxes:** You are responsible for any applicable sales or use taxes. If we are required to collect taxes, the amount will be shown at checkout.

### 5. REFUND POLICY
We want you to be satisfied with our Services. Our refund policy is as follows:

| **Game Day Coverage** | Non-refundable if canceled within 7 days of scheduled event. If event is canceled due to weather or circumstances beyond our control, we will reschedule or issue a credit. |
| **Photography Services** | 50% refund if canceled at least 48 hours before scheduled session. No refund for no-shows or last-minute cancellations. |

### 6. DELIVERY TIMELINE
We strive to deliver your Services promptly. Estimated timelines:

**Delays:** If we anticipate a delay, we will notify you promptly. You are responsible for providing all required materials (videos, information) in a timely manner; delays caused by you may extend delivery timelines.

### 7. INTELLECTUAL PROPERTY RIGHTS
**Our Content:** The Site and its entire contents, features, and functionality (including but not limited to text, graphics, logos, images, and software) are owned by Dream Hammer Media LLC and are protected by copyright, trademark, and other intellectual property laws.
**Your Content:** By submitting videos, photos, or other content to us ("User Content"), you grant us a non-exclusive, worldwide, royalty-free license to:
- Use, reproduce, modify, and display the User Content for the purpose of providing our Services
- Use excerpts (e.g., short clips, screenshots) in our portfolio, marketing materials, and social media to promote our Services
**Portfolio Use:** We may use your final videos and photos in our portfolio, website, and social media unless you opt out in writing. We will never imply endorsement without permission.
**Ownership of Final Product:** Upon full payment, you own the final video and photo deliverables. We retain the right to display them in our portfolio as described above.

### 8. USER RESPONSIBILITIES AND CONDUCT
By using our Services, you agree to:
- Provide accurate, current, and complete information
- Obtain all necessary permissions (including parental consent) for minors
- Ensure you have the right to share any videos, photos, or content you provide
- Use our Services only for lawful purposes
- Respect the intellectual property rights of others
**You agree NOT to:**
- Submit false or misleading information
- Upload content that infringes on third-party rights
- Harass, abuse, or harm our staff or other users
- Attempt to gain unauthorized access to our systems
- Use our Services for any illegal purpose

### 9. MEDIA RELEASE
By using our Services, you grant Dream Hammer Media LLC permission to:
- Photograph, film, and record you (or your athlete) during sessions
- Use such photographs, videos, and recordings in our portfolio, website, social media, and marketing materials
- Edit, alter, or reproduce such content as we see fit
You waive any right to inspect or approve such uses. You release us from any claims related to the use of such content.
**To opt out of media release:** You must notify us in writing at dreamhammerllc@gmail.com before your session begins. Opting out may limit how we can use your content but will not affect delivery of Services.

Our Services integrate with third-party platforms including:

- Rapsodo and HitTrax (metric profiles)
- Acuity Scheduling (appointment booking)
- Stripe (payment processing)
- JotForm (form hosting)
We are not responsible for the practices, content, or availability of these third-party services. Your use of them is subject to their own terms and privacy policies.

### 11. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Dream Hammer Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services.
Our total liability for any claim arising from or related to our Services shall not exceed the amount you paid to us for the specific Service giving rise to the claim.
**We do not guarantee specific recruiting outcomes.** While our Services are designed to enhance your exposure, we cannot guarantee that you will receive college offers, scholarships, or recruitment by any particular program. Recruiting success depends on numerous factors beyond our control.

### 12. DISCLAIMER OF WARRANTIES
Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
- Our Services will be uninterrupted, timely, secure, or error-free
- The results obtained from using our Services will be accurate or reliable
- Any errors will be corrected
We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

### 14. CANCELLATION AND RESCHEDULING POLICY

### 15. FORCE MAJEURE
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, weather, pandemics, war, terrorism, labor disputes, or government actions.

### 16. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any legal action arising out of or relating to these Terms or our Services shall be brought exclusively in the state or federal courts located in Solano County, California.

### 17. DISPUTE RESOLUTION
**Informal Resolution:** Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at dreamhammerllc@gmail.com. We will attempt to resolve the dispute within 30 days.
**Binding Arbitration:** If informal resolution fails, any dispute arising out of or relating to these Terms or our Services shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. The arbitration shall be held in Solano County, California.
**Class Action Waiver:** You agree to resolve disputes on an individual basis and waive the right to participate in class actions.
